We request Commissioners Court consider approval of the Agreement between the Texas Department of Transportation (TxDOT) and Collin County for 10% of the right-of-way (ROW) acquisition costs related to the project along SH 5 from SH 121 to CR 375. (Agreement attached)

TxDOT is currently finalizing the Preliminary Engineering for the SH 5 Project. They anticipate receiving environmental clearance in April 2018 and can start Right of Way acquisition after that. The state must have all appropriate Right of Way agreements in place before they can start Right of way acquisition. The project is scheduled to let for construction in April 2021.

The Cities of Anna and Melissa have both petitioned the county to pay their respective participations for the project. The breakdowns are as follows and the request letters are attached:

Collin County 10% = $229,853.20
City of Anna 10% = $1,668,730.80
City of Melissa 10% = $1,113,093.40
TOTAL = $3,011,677.40

TxDOT estimates the cost of right-of-way and Utilities to be $30,116,774. The 10% share will be $3,011,677.40

The following budget amendments are being proposed to fund the project:
$347,434 from project #99-00-00 (1999 Bond Program Discretionary. This will clear account)
$2,122 from project #03-115 (2003 Bond Program Discretionary. This will clear this account)
$358,115 from project #07-00-00 (2007 Bond Program Discretionary. This will clear this account)
$579,818 from project #07-00-55 (SH 5 from US 380 SH 121)
$1,724,189 from project #07-00-54 (FM 2514 from Lavon Parkway to Brown Street)

ACTION:
1) Approval of the Agreement to Contribute Right of Way Funds (Fixed Price) SH 5 from SH 121 to CR 375; NEW 2007 Collin County Discretionary Bond Project # 07-00-67

2) Approval of the associated budget amendments to fund the new project.

Request Commissioners' Court consideration and any action regarding approval of the Agreement to Contribute Right of Way Funds (Fixed Price) for certain highway improvements on SH 5 from SH 121 to CR 375; NEW 2007 Collin County Discretionary Bond Project # 07-00-67 and approval of the budget amendments to fund the new project. Further authorize the County Judge to execute same. md

Collin County's participation is $3,011,677.40.
