Department Action

In order for the Collin County Sheriff’s Office to regulate traffic within the Inspiration Development, Commissioner Court must approve regulatory sign warrants within the District.

Texas Transportation Code gives the court guidance on how to go about regulating roads within Special Districts. Section 251.151 (b)

Sec. 251.151. Authority of Commissioners Court to Regulate Certain Roads.
“The commissioners court of a county may by order apply the county’s traffic regulations to a public road in the county that is owned, operated, and maintained by a special district and located wholly or partly in the county if the commissioners court and the board of the district have entered into an interlocal contract under Section 791.036, Government Code.”

By approving the attached Interlocal Agreement, the county’s Sheriff’s office is able to regulate the traffic control signage within the District. Staff has sought attorney’s opinion and the opinion of the Collin County Sheriff’s office and edits have been made to the attached agreement.

Once this agreement is approved, staff will start the public notification process, for the sign warrants, and then seek Commisisoners Court approval at a subsequent court date.
The roads will be maintained by the District.

Purchasing Department Action

Request Commissioners' Court consideration and any action regarding approval of the interlocal agreement between Collin County and County Water Control and Improvement District No. 03 (Inspiration) for Traffic Regulation in Special District beginning on the date of approval through October 30, 2022. Agreement will automatically renew for (5) year terms unless affirmatively cancelled by either party with thirty (30) days written notice. Further authorize the County Judge to execute the agreement. md
