On September 27, 2010, via Commissioners Court, CO#2010-762-09-27, approved an Agreement to Contribute Funds – Local Government with the Texas Department of Transportation (TxDOT) for 10% Right of Way participation on SH78 at Spring Creek to SH205 (bond project 07-0007). At that time, TxDOT’s practice was to send the request for participation in small cities to the County. And it was the practice of the County to pay that participation. However, the following are the portions by entity: Collin County 63%; Wylie 33%; Lavon 4%. The local government’s share at that time was estimated to be $223,149.40, and the County paid that amount.

Per the attached letter, Texas Department of Transportation has completed the right of way acquisition and utilities, but the total local share is $529,237.06. Therefore, a balance of $306,087.66 is currently due. The bond account 07-00-07 remains open with a balance of $0. The budget adjustment below will reallocate funds from FM1378 ROW project.

We seek Commissioners Court approval of the following budget adjustment to pay the remaining balance:
