Department Action

On April 18, 2011, via Commissioners Court, CO#2011-241-04-18, approved an Agreement to Contribute Funds – Local Government with the Texas Department of Transportation (TxDOT) for 10% Right of Way participation on SH78 at Business 78 to FM6 (bond project 07-0011). This project was then and is now totally in the City of Lavon. However, TxDOT had the practice in 2011 of sending requests for ROW participation in small cities to the County. And the County had the practice of paying all of the participation even if part or all of the project was in a small city. The amount estimated for ROW in 2011 was $395,000; therefore, since the local government’s share is 10%, the County paid $39,500. After that payment the County was able to determine that the Grand Heritage Municipal Utility District in the City of Lavon had funding available, so the County was reimbursed the $39,500.

Per the attached letter, Texas Department of Transportation has completed the right of way acquisition and utilities, but the final total is $512,858.02. Therefore, the County’s share, per the signed agreement, is $51,285.80, and a balance of $11,785.80 is currently due. The bond account 07-0011 remains open with a balance of $0. The budget adjustment below will reallocate funds from FM1378 ROW project.
