Department Action

The Community ISD is in the process of building a new high school on FM 1138. They need turn lanes before the school opens next year to make the access safe. Their plans have been approved by TxDOT, but the District must pay for the construction. TxDOT has determined that they have a contractor who can do this work within the timeframe needed by the District, but TxDOT has a policy of not contracting with school districts. Therefore, TxDOT and the Community ISD have asked Collin County to contract both with TxDOT and separately with Community ISD in order to be paid by the District and in turn pay TxDOT for the work.
On June 11, 2019, we brought the agreement with Community ISD to the Court for consideration. At that time we did not have the agreement from TxDOT. The Court did not take action and directed the staff to bring the item back when we had both agreements to consider. We have now received the agreement from TxDOT. The amount that is needed by TxDOT for their contractor is $738,834.
Attached is the agreement from TxDOT. The agreement with the Community ISD was in a previous agenda item. The agreement with TxDOT is contingent upon execution of the Community ISD agreement. Once these are fully executed Community ISD will pay the County. Then Collin County will pay TxDOT. TxDOT will then authorize their contractor to perform the work. It is recommended that the Commissioners Court approve this agreement with TxDOT, authorize the County Judge to execute it and authorize payment to TxDOT after receipt of the required amount from Community ISD.

Request Commissioners Court consideration and any action regarding approval of a Local Project Advance Funding Agreement for Voluntary Local Government Contributions to Transportation Improvement Projects with no Required Match between TxDOT and Collin County for the construction of a left and right turn lanes, driveways and drainage improvements along FM 1138 from north of CR 595 to south of CR 913 in Collin County, further allow County Judge to execute same. MD

Community ISD is paying $738,834 to Collin County and Collin County will submit $738,834 to TxDOT.

Community ISD will pay Collin County $738,834 and Collin County will submit those funds to TxDOT to perform the work. Agreement with Community ISD is on Agenda 47255. Road and Bridge Fund (1010).
