Department Action

TxDOT is widening SH 205 just south of SH 78 in Collin County. Median cuts will be placed at roadway intersections; however, a private citizen has requested a median cut for their business. This request is acceptable to TxDOT as long as the citizen agrees to pay for the cost of the improvement in full.

TxDOT will not contract with a private citizen but can go under contract with a local goverment. Therefore, TxDOT and the citizen have asked to separately contract with Collin County. Separate agreements will be initiated in order for the payment to transfer. An Agreement between the County and the citizen will allow for the citizen to pay the County the full and fixed improvement cost in the amount of $87,691.10. In turn, an AFA between the County and TxDOT will allow for the County to transfer the fixed payment in full in the amount of $87,691.10 to TxDOT.

This subject is being presented as a combined agenda item in order to facilitate the process of receiving payment from the citizen and making payment to TxDOT. The County’s attorney has prepared an Agreement and TxDOT’s legal team has prepared the AFA. The Engineering Department requests that the Commissioners Court approve the attached Agreements with the citizen and TxDOT to facilitate the construction of the requested median cut for the citizen’s business.

Recommended Action: It is requested that the Commissioners Court
-approve the Agreement and receive $87,691.10 from the citizen, funds will be placed in the Road and Bridge Fund (1010-00000-0000-00-00-0000-21000).
-approve the AFA and transfer $87,691.10 to TxDOT

Purchasing Department Action

Request Commissioners Court consideration and any action regarding approval of an Agreement between Collin County and a private citizen; and an AFA between Collin County and TxDOT concerning widening SH 205 south of SH78 in Collin County, further allow County Judge to execute the same. The Private citizen will remit $87,691.10 to the County and the County will then remit $87,691.10 to TxDOT. ED

Budget Department Action

No budget impact to the county. Once both agreements are executed and funds received from the private citizen, the county will transfer those same funds to TxDOT.
