Department Action

During the last session of the Texas Legislature, HB 3697 was approved which amended Section 232.0033 of the Local Government code to prohibit counties from denying a plat for failure to identify a transportation corridor unless the corridor is part of an agreement between the County and the Texas Department of Transportation (TxDOT). This results in preventing the County from requiring that a developer provide for a future roadway that is identified in the County’s Thoroughfare Plan unless the County has an agreement with TxDOT.

TxDOT has responded to the need for such agreements by establishing forms and a simplified agreement for counties to use to request such an agreement with TxDOT. It has been determined that the County can regain the authority to require future thoroughfares in developments by attaching the County’s Thoroughfare Plan to the agreement with TxDOT. Attached are the forms, agreement and the Collin County Thoroughfare Plan to be submitted to TxDOT.

Recommended Action: It is recommended that the Commissioners Court approve the attached agreement with TxDOT and authorize the County Judge to sign the documents necessary to complete a submission to TxDOT for the agreement on transportation corridors in Collin County.

Request Commissioners Court consideration and any action regarding approval of 2024-211 Collin County Corridors Agreement with TXDOT, per attached Collin County Corridors Agreement and County Corridor Agreement Request form between Collin County and Texas Department of Transportation (TxDOT) concerning Identification of Future Transportation Corridors Within Collin County. Further, authorize the County Judge to execute same. ED
