Department Action

The Engineering Department requests the approval of Amendment No. 2 to the Engineering Services Agreement (ESA) with BGE, Inc. As the Outer Loop (FM 2478 to SH 75) Project has been brought further into design, BGE has identified two locations of the service road that will have steep slopes requiring retaining walls or additional easements for grading, thus increasing the construction and/or ROW costs of the project. It was determined and recommended that in the areas where these grade issues were occurring, the alignment of the service road can slightly shift away from the ROW in order to eliminate the need for retaining walls or additional property easements. This change was a less expensive option.

In addition to the alignment shift, BGE will be providing exhibits to aid in Access Control. Over the course of the design of this project, several property owners and potential property investors have been looking to develop their parcels and have been inquiring on where driveways can be placed to have access to the Outer Loop. These Access Control Exhibits will assist the County in determining/permitting driveway access along the Outer Loop while maintaining TxDOT Access Management Standards in the interim and ultimate conditions for Outer Loop.

The net change is adding $146,927.00 to the contract, to cover the additional design efforts. Currently, there is $0.62 available in in the consulting account. Therefore, the remainder needed for this amendment, $146,926.38, needs to be moved from within the project to the consulting account with a budget adjustment.

Action Requested: It is requested that Commissioners Court approve the attached Amendment No. 2 and a budget adjustment to transfer $146,926.38

Request Commissioners Court consideration and any action regarding approval of contract amendment No. 2 to the contract with BGE, Inc., AGR. 2020-049, Collin County Outer Loop, Segment 3A Access Rd. PS&E from FM 2478 to US 75, for additional services to shift alignment at two locations of the service road and provide exhibits for access control for an additional fee of $146,927.00 for a new total contract amount of $2,399,973.22. Further, authorize the Purchasing Agent to execute same. MD
