HB 1150 created three periods for fireworks to be sold to the public if authorized by Commissioner’s Court. The periods are Texas Independence Day (between February 25 and midnight on March 2), San Jacinto Day (between April 16 and midnight April 21), and Memorial Day (between the Wednesday before the last Monday in May and midnight on the last Monday of May). The Commissioner’s Court must adopt the authorization order before February 15, 2023. In contrast to the traditional Fourth of July and December fireworks sales during which sales are permitted absent a finding by the court that drought conditions exist, these three fireworks periods are at the discretion of the Commissioner’s Court as to whether or not the sales will be allowed.
