Department Action
Texas Occupations Code 2154.202 defines when a retail fireworks permit holder may sell fireworks to the public. July 4th and New Years' Eve are allowed by statute. Additional selling periods are allowed only if they are authorized by the Commissioners Court by order. These additional periods are Texas Independence Day, San Jacinto Day, Memorial Day and Diwali.
 
Texas Local Government Code 352.051 provides the ability to restrict fireworks sales during drought conditions. These restrictions must be adopted before certain dates relevant to a particular selling season.
 
I respectfully ask to the Commissioners Court to consider and approve an order authorizing all additional selling periods listed above. The Fire Marshal's Office will continue to monitor drought conditions and make recommendations for restrictions when drought conditions exist.
