Department Action

House Bill 1445 provided provisions for “one stop shopping” for subdivision plat approval. A new ILA which utilizes provisions in LGC 242 that establish a single set of consolidated and consistent regulations related to plats, has been approved by the Fate City Council and is being presented to you for consideration.

This guidance can be found under 242 .001 (d) (4) (B)
establishes a single set of consolidated and consistent regulations related to plats, subdivision construction plans, and subdivisions of land as authorized by Chapter 212, Sections 232.001-232.005, Subchapters B and C, Chapter 232, and other statutes applicable to municipalities and counties that will be enforced in the extraterritorial jurisdiction.

The attached ILA creates a set of regulations that developers will adhere to during platting. Fate will remain the responsible authority for approving the plat. The County will only be involved in situations where there is floodplain, if there are new roadways that the County will be asked to maintain or if the lots will utilize On Site Sewage Facilities.

Action Requested:
We request Commissioners Court consideration of the Interlocal Agreement with the City of Fate concerning Subdivision Regulation within the City of Fate’s ETJ.

Request Commissioners Court consideration and any action regarding approval of an Interlocal Cooperation Agreement between Collin County and the City of Fate for Platting and Subdivision Regulation in the Extraterritorial Jurisdiction of the City of Fate and further authorize the County Judge to execute same.
