Department Action

The Texas Department of Transportation (TxDOT) is ready to begin acquisition of right of way (ROW) for the Spur 399 Freeway. TxDOT requires participation of the local governments in which a project is located in the amount of ten percent of the cost of the ROW and utility relocations. Per our request TxDOT prepared the attached agreement to include those costs for both the City of McKinney and Collin County. The agreement calls for payment of $8,572,909.50.

Recommended Action: It is recommended that the Commissioners Court

Approve the attached agreement with TxDOT
Authorize the County Judge to execute the agreement
Authorize the payment of $8,572,909.50 from account RI18002-4021-750300013-809683 when the agreement is fully executed

Purchasing Department Action

Request Commissioners Court consideration and any action regarding approval of an Agreement to Contribute Right of Way Funds (Fixed Price) regarding certain highway improvements on Highway No. SS 399 from SH 5 to US 380 for the acquisition of certain right of way and the relocating and adjusting of utilities. Further, authorize the County Judge to execute same. MD

Collin County's participation is a NTE $8,572,909.50.
