Department Action
Recently we have looked into recycling the used license plates which are returned to our office when the taxpayer receives new plates.

Researching the local recycle centers, we found they will accept and recycle the plates, paying us approximately $.15 per pound.  (This amount can fluctuate due to current metal prices.)

In speaking with the Department of Motor Vehicles, it is their view that the funds be used for the betterment of the employees of the Tax Office.  Our plan is to follow their recommendation.  We have put procedures in place that supports this action.

Through recycling, we are promoting a good image for the County as well as rewarding the hard work that our staff puts forth to serve the taxpayers.

We have collected $3,605.59 from the recycling of returned license plates.  None of the money has been spent.

I am requesting an opinion from Greg Hudson as to how these funds may be used and hope to have it available before the Commissioners Court meets.  I could find no law or AG opinions that addresses these funds, and I am not sure the Department of Motor Vehicles has the legal authority to determine how these funds may be spent.  It is my understanding of the law that if there is no law that specifically addresses revenues to the County that the revenues must be deposited into the General Fund and the Commissioners Court has the authority as to how to spend the funds.
