You may remember that when local government contributions for the ROW for SH 5 were discussed in the past it was determined that there were some errors in the ROW estimates, so TxDOT was going to re-develop the estimates. We now have the estimated amount of ROW that is in the unincorporated area of SH 5 between SH 121 to the north County Line (CR 375). The dollar amount of the County’s 10% share of the ROW cost is $222,606.30.
The last time the Court discussed this subject, the Cities of Anna and Melissa had requested the County cover their share of the cost, which was over $2 million. The Court told them to pursue other options, us loans, etc. At the writing of this memo it is my understanding that both Cities plan to fund their shares themselves. I am double-checking with them to make sure, and will inform you at the Court meeting if either of them plans to make another request for the County to pay their share.
The funding for the County’s participation will come from the discretionary portion of the 2007 bond program. We propose transferring the necessary amount from another portion of SH 5 (south of SH 121) which is not as far along in its development.

It is recommended that the Court approve the attached agreement for the Collin County share of the ROW costs for SH 5 between SH 121 and CR 375 as well as the budget amendment.

Request Commissioners' Court consideration and any action regarding approval of the Agreement to Contribute Right of Way Funds (Fixed Price) for certain highway improvements on HWY 5 from SH 121 to CR 375 ROW for the acquisition of certain right of way and the relocating and adjusting of utilities; further authorize the County Judge to execute same. MD

Collin County's participation is a fixed price of $222,606.30.
