Department Action

A grade separated overpass across the BNSF Railroad will be required as part of construction for the Collin County Outer Loop between State Highway No. 289 and the Dallas North Tollway.

Accordingly, the BNSF Railroad requires our approval of an Overpass Agreement outlining terms, conditions and obligations of both BNSF, Collin County and our contractor.

Included within the Overpass Agreement are the following exhibits:

Collin County is also required to pay BNSF $133,650. This amount represents a $2000.00 BNSF Administrative Fee and $131,650.00 for the Easement Agreement from BNSF to Collin County.

Commissioners Court’s approval and execution of the attached Overpass Agreement as well as authorization to pay costs associated with this agreement is requested.

Request Commissioners' Court consideration and any action regarding an Overpass Agreement between Collin County and BNSF Railroad Company regarding the construction of the Collin County Outer Loop between State Highway No. 289 and the Dallas North Tollway outlining terms, conditions and obligations of both BNSF, Collin County and our contractor for consideration of $133,650 which represents a $2000.00 BNSF Administrative Fee and $131,650.00 for the Easement Agreement. Further authorize the County Judge to execute the overpass agreement only at this time. MD
