Department Action
Construction of the improvements to Frontier Pkwy, including a bridge and a temporary road crossing over the BNSF Railroad line, has begun. In order to construct a bridge and a temporary road crossing over the railroad, the County must enter into an agreement with RailPros to provide a certified Roadway Worker in Charge (RWIC) for on-track safety.
 
Attached is the “Services Agreement” along with the quote for RWIC Services and a proposed RailPros flagging schedule.  In order for BNSF to allow work on or near their rail system, a RWIC was required per the Executed Overpass Agreement with BNSF dated 12/18/2020.  RailPros will provide a certified RWIC with extensive railroad experience. Due to the unknown nature of when a RWIC will be necessary, the proposed cost will be will be based off of 100 days at the higher rate to include a one-time Administrative Fee, Nights, Weekends and Holidays and 2 hours overtime rate per day in the total amount of $159,550.00; however, we are very optimistic that it will be much less than this. It is highly likely the actual rates to be charged will be for a Standard Workday which will reduce the amount to be paid. RailPros will only be compensated for actual work completed with the appropriate rates assigned.  
 
Action:
It is requested that the Commissioners Court approve the Services Agreement with RailPros Field Services, Inc., authorize execution by the Purchasing Agent and authorize payment of $159,550.00.

Request Commissioners Court consideration and any action regarding (1) approval of Services Agreement No. 2021-289 between Collin County and RailPros Field Services, Inc. to provide railroad flagging services for the construction of Frontier Parkway as required by the BNSF Railway Overpass Agreement approved by CO# 2020-1164-11-23; and (2) approve an exemption from the competitive bid process in accordance with V.T.C.A. Local Government Code 262.024 (a)(2) an item necessary to preserve or protect the public health or safety of the residents of the county. Further, authorize the Purchasing Agent to execute same. MD
