When the Commissioners Court awarded funds for the improvement of W. Lucas Rd. to the City of Lucas, the Court placed a condition that the remainder of the ROW be acquired to provide 120’ of ROW for the whole length of the project. The procedure is for the City to begin acquisition of the additional ROW concurrently with the preparation of the construction plans, both with City funds. The County would provide the award for construction funding if all the ROW has been acquired by that stage. The City of Lucas has now requested that the County consider a different approach to acquiring the necessary additional ROW for Lucas Rd. Instead of the City acquiring the ROW and the funding for the project being held until the ROW is acquired, they are requesting that the County acquire the ROW using funds that were designated for ROW in their proposal ($826,000). This would allow them to move forward with the project without taking the chance it would be held up by the ROW acquisition process (because the additional ROW is not required for the improvements). Twenty-nine parcels will have to be acquired. Appraisals would need to be performed as soon as possible to determine whether or not the $826,000 is enough. If it is not, the additional amount needed will have to come out of the award which reduces what is available for design and construction – obviously the City needs to know that as soon as possible. This is not the way that City projects partially funded by the County have been executed in the past. However, there is no law or rule to prevent this; it is a policy decision of the Commissioners Court. It is requested that the Commissioners Court vote on acquiring the additional ROW for W. Lucas Rd using funds awarded to that project.

This program will train 250-300 officers in remote video sessions as a part of the Sheriff's Office COVID-19 response. If approved, it is also requested to grant an exemption from the usual bidding requirements of state purchasing law.

Department is requesting $146,650 in CARES Act funding for the purchase of online classes. The training program payment would cover 24 months of training. Per CARES Act Guidance updated June 30, 2020, "CARES Act provides that payments from the Fund may only be used to cover costs that were incurred during the period that begins March 1, 2020, and ends on December 30, 2020." The Guidance was updated June 30, 202 to clarify cost incurred. "Treasury is clarifying that for a cost to be considered to have been incurred, performance or delivery must occur during the covered period but payment of funds need not be made during that time (though it is generally expected that this will take place within 90 days of a cost being incurred)." Based on clarifications of the CARES Act guidance, the Budget department does not recommend the use of CARES Act funding for this request.

Per the guidelines, the "performance or delivery must occur during the covered period", which is only through December 30, 2020. Department Action
The Sheriff's Office is respectfully requesting approval for CARES Act Funds to purchase MDC's and equipment for remote work in the amount of $355,268.90. This will enable 19 Deputies to work remotely and directly support the Sheriff's Office in response to COVID-19.
Purchasing Department Action
No action by Purchasing at this time. If approved, purchasing policies and procedures will apply. MDC, etc. purchase will require Commissioners Court approval once quotes have been finalized per Court order 2020-426-05-18 utilizing CARES ACT funding.

Budget Department Action
Department requesting $355,368.90 in CARES Act funding for the purchase of 19 MDCs, 4 laptops and 5 MiFis. Department’s hardware was refreshed February-June of 2020 (see attached). Budget department does not recommend the use of CARES Act funding for this request.
Auditor's Office Action
The purchase of a second computer is not justified to fit within the guidelines of the Cares Act funding as laptops were just purchased during the County's refresh period.
