Five proposals were received for the Frontier Pkwy Paving and Drainage Improvements project. Mario Sinacola & Sons Excavating Inc (MSSEI) received the highest ratings after evaluations conducted by a six-member panel, including representatives from our partners, the Town of Prosper and the City of Celina. Although the proposed price was not the only factor, it should be noted that the lowest two price proposals were with one percent of each other. All but one of the price proposals were at or below the Engineers Estimate. MSSEI’s proposal was 8 percent lower than the Engineers Estimate. Among other factors that gave MSSEI the highest rating was their experience with similar projects in cities. Lastly MSSEI proposed a schedule that is substantially shorter than either the engineer’s projected schedule or the other proposals. The engineer’s projected schedule was 960 days; MSSEI has proposed a process of construction that will be completed in 633 days. As this memo is being written, the Councils of the Town of Prosper and the City of Celina are considering resolutions that approve of the proposal submitted by MSSEI and authorize payment of the required contributions of the municipalities. By the time the Commissioners Court considers this item, the County will have received the resolutions approved by Prosper and Celina as well as their payments. The funding for this project included city bond funds, Regional Toll Revenue funds and County bond funds. Action Requested: It is requested that the Commissioners Court authorize the County Judge to execute an agreement, with a total of $21,917,968, with Mario Sinacola & Sons Inc to construct the improvements to Frontier Parkway. It is further requested that the Court authorize the funds that are received from The Town of Prosper and the City of Celina be assigned to this project and transferred from a revenue account to an expenditure account for this project, RI07014 and RI18006CO.

Two amendments to Birkhoff, Hendricks and Carter’s (BHC) contract are needed. The scope of the current agreement with BHC assumes that the process for selecting a contractor would be the typical low-bid process. However, it was determined that the Competitive Sealed Proposal process would be the best was to select a contractor for this particular project. That process required additional work by BHC which is explained in the attached amendment proposal. This is styled Amendment No. 9, and is an increase of $46,286. The Interlocal agreement we have with the Town of Prosper and the City of Celina requires this amount to be shared by the County and the two municipalities (one-third each). Also the Town of Prosper has proposed that a “Project Visualization” effort for this project. This effort provides a video that shows the “before and after” of the improvements to the project. It is extremely useful in communicating to the public the nature of the improvements to expect when the project is completed. It, of course, will also help the Councils and Commissioners Court to see the improvements as well. The cost of this is consists of the video creation by RDV Systems, Inc., as a sub-consultant to BHC, as well as additional tasks performed by BHC to provide RDV the materials it needs to create the video. This is styled as Amendment No. 10, and is an increase of $42,850. The Interlocal agreement we have with the Town of Prosper and the City of Celina requires this amount to be shared by the County and the two municipalities (one-third each). These amendments require a budget adjustment in order to move funds within the project to the appropriate object code. The requested adjustment is shown below. Over the last year, the City of McKinney, Collin County, the North Texas Municipal Water District (NTMWD) and the Texas Department of Transportation (TxDOT) have worked on determining the “footprint” of a segment of the future US 380 alignment that will be in the Bloomdale corridor. This footprint has now been determined to the satisfaction of the staffs of the City of McKinney, Collin County and the NTMWD. Although the TxDOT has determined the validity of this as an option for the future freeway, it cannot establish this as the alignment at this time. The TxDOT is in the process of conducting an Environmental Impact Statement for the freeway in this segment and must allow this process to determine the final alignment. There is no alternative alignment for this segment between the future Ridge Road and approximately Community Avenue (other than along the existing US 380 alignment which the City of McKinney has gone on record opposing). Therefore, the staffs of the City of McKinney and Collin County are confident that the “footprint” depicted in the attached illustrations will be the alignment. It is urgent that the land for this segment be acquired as soon as possible because there are developments along this alignment that are platting their residential development and will build houses in this alignment if the land is not acquired from them soon. In addition the NTMWD needs to install a large water supply line to the City of McKinney as soon as possible for the City to be able to adequately serve their growing population. The easement that they need is part of the alignment that has been established. Attached is a draft resolution for consideration by the Commissioners Court. This resolution is similar to a resolution passed by the McKinney City Council on October 6, 2020, approving this alignment. This resolution also authorizes and directs the Collin County Engineering Department to facilitate the County’s acquisition of the land in this segment. Funds are available from the County’s 2018 Bond Fund. Action Requested: It is requested that the Commissioners Court approve the attached resolution and authorize and direct the Engineering Department to begin acquiring land in this corridor.
